Terms and Conditions of Use

The website www.wewardapp.com and the WeWard mobile application are published by WEWARD, a simplified joint-stock company with a share capital of €1,196.03, whose registered office is located at 111 Avenue Victor Hugo, Paris (75016), registered with the Paris Trade and Companies Register under number 85361417000035 ("WeWard" or "we").

These terms of use (the "T&Cs") define the conditions of your access to and use of the Site. We encourage you to read them carefully. For the purposes of these Terms, all capitalized terms have the meanings assigned to them.

Preamble


We have developed the WeWard mobile application ("the Application") to motivate Users to prioritize walking in their daily activities for health and environmental reasons.

The Application allows Users to earn points ("Wards") based on actions or features promoted within the Application. For example, Users can earn Wards based on the number of steps they take or by completing bonus actions in the Application.

Wards can be used to unlock rewards displayed within the Application, under the conditions outlined in Article 7 of these terms.

Article 1 – Definitions


Application: Refers to the WeWard mobile application, available on iOS and Android.

Wards Wallet:
Refers to the balance of Wards associated with the User Account.

Account or User Account:
Refers to the personal space dedicated to the User within the Application, which they can access by registering and logging into the Application after accepting the Terms and Conditions.

Suppliers:
Refers to WeWard partners offering products for sale on the WeWard Application.

Products:
Refers to all products offered for sale directly by WeWard or through Suppliers on the Application.

Virtual Products:
A type of WeWard Product that includes virtual items, e-vouchers, or privileges on WeWard.

Reward(s):
Refers to all the opportunities available to the User in exchange for using Wards, such as gift cards, virtual items, cash prizes, shopping vouchers, discounts on products, support for humanitarian or ecological projects, and goods or services available on the Application.

Service(s):
Refers to all services provided by WeWard through the Website and the Application.

 Website:
Refers to the website www.wewardapp.com.

User:
Refers to any individual registered on the Application and holding an Account.

Visitor:
Refers to any individual accessing the Services without holding the status of a User.

Wards: Refers to the points accumulated, usable only within the Application, which allow Users to unlock the Rewards displayed in the Application.

Article 2 – Registration and Account Creation

2.1 - Registration Conditions

Registration for the Application is open exclusively to individuals aged fifteen (15) or older with internet access. By registering on the Application, the User declares and warrants that they are fifteen (15) years of age or older. We reserve the right to request any document that verifies the identity and age of the individual creating the Account.

Registration for the Application is free and does not require any purchase or financial compensation from the User to WeWard.

When creating an Account, the User acknowledges having read and accepted the entirety of these Terms and Conditions.

By registering on the Application, the User also confirms having read our Privacy Policy, which is incorporated by reference into these Terms and Conditions.

2.2 - Account Creation

The use of the Application is free of charge. To create an Account, you must complete the registration form accessible via the Application.

You can also create an Account using a third-party service such as Facebook, Apple, or Google, and, if necessary, provide any missing information. In such cases, the User acknowledges and agrees to allow WeWard to use the data provided by the third-party service.

You agree to provide a valid email address that you own and represent and warrant that the information you provide is accurate and complete.

Article 3 – Acceptance of the Terms and Conditions of Use (T&Cs)

3.1 - Acceptance

When creating an Account, the User is free to check the box stating, "I accept the Terms and Conditions of Use and certify that I am over 15 years old."

Checking this box constitutes proof that the User has read our T&Cs via the Application and constitutes unreserved acceptance of them.

IF YOU DO NOT ACCEPT ALL THE TERMS OF THE TERMS AND CONDITIONS OF USE AND REFUSE TO BE BOUND BY THEM, PLEASE REFRAIN FROM USING OUR SERVICES AND DELETE YOUR ACCOUNT IF APPLICABLE.

Specific conditions may apply or be added during the use of certain Services in accordance with the provisions set out in Article 3.3. These additional documents will be incorporated into the present T&Cs.

3.2 - Enforceability

These Terms and Conditions of Use (T&Cs) take effect on the date they are published online and are enforceable:
- From the moment the User accepts them during their registration on the Application and throughout the use of the Services; or
- 30 days after they are communicated to Users, when new T&Cs replace the previous ones; or
- On the day they are published online, in the case of minor updates to the T&Cs that concern non-substantial elements.

Subject to compliance with these timeframes, the T&Cs published on the Application take precedence over any earlier versions. They nullify and replace all prior versions. The User may choose to stop using the Services and delete their Account at any time, but they remain bound by any previous use of the Services.

3.3 - Modifications

We reserve the right, at our sole discretion, to adapt or modify these Terms and Conditions at any time without notice. We may do so for various reasons, including to reflect non-substantial changes or provisions modified by law, the introduction of new features, or changes in business practices.

A User who does not wish to accept the modified Terms and Conditions may delete their account and stop using the Services.

Any use of the Application and/or Services after the applicable notice period (Article 3.2) constitutes acceptance of the modifications.

Article 4 – Access to Services

Access to our Services requires having an Account on the Application. The Application can be downloaded for free from the Apple App Store and Google Play Store. Access to the Application is free (excluding connection and telecommunications costs, which are the responsibility of the User).

Our Services aim to motivate Users' physical efforts and daily actions in a fun and interactive manner. Under no circumstances should our Services be interpreted as services that provide a source of income or professional earnings.

Access to our Services is strictly personal and private. WeWard is in no way responsible for any procedures that may apply to the obtaining and/or receiving of Rewards (such as declarations, taxation, fees, etc.). Therefore, the User is prohibited from using the Application in a professional, commercial, or competitive context. Any violation of this provision may result in the closure of the Account.

The User is informed that, in order to benefit from certain Services available in the Application, they are required to agree to share their geolocation and/or track their physical activity via their smartphone’s native sensors or connected devices. Failure to do so will prevent the User from earning Wards, particularly for those requiring the calculation of steps taken or tracking visits to recommended locations. For more information on the data we collect from you and how we use it, please refer to our Privacy Policy.

We reserve the right, without prior notice or compensation, to temporarily or permanently close all or part of the Application or access to the Services remotely, particularly for updates, maintenance, modifications, or changes to operational methods, servers, and access hours. In case of any anomaly, we will take all necessary measures to restore the Application's accessibility and functionality.

Article 5 – User Obligations


The User agrees to use the Application and the Services only under the conditions defined herein.

In particular, the User agrees to:
- Not use the Application or the Services for professional, commercial, or profit-driven purposes.
- Not provide WeWard with false, misleading, deceptive, or fraudulent information (including when creating or updating the Account).
- Not create more than one Account on the Application and not open an Account on behalf of a third party.
- Not use another User's Account, share an Account with another User, or manage multiple User Accounts.
- Not post referral codes on review sites, such as the Apple Store, Google Play, or Trustpilot.
- Not use the Services for harmful or malicious purposes.
- Not infringe on WeWard's rights or image, particularly its intellectual property rights.
- Not use the Services to generally harm WeWard.
- Not use the Services for illegal purposes or those prohibited by these Terms and Conditions.

Any violation of these commitments constitutes a serious breach of the User's contractual obligations under these Terms and Conditions.

It is the User's responsibility to ensure that their hardware and transmission systems are in proper working order and up to date to fully benefit from the functionalities of the Services and the Application.

The User is responsible for maintaining, using, and keeping their login credentials and password confidential.

The User agrees to notify WeWard immediately if their password is communicated to a third party, stolen, or compromised.

Furthermore, the User acknowledges that they are solely responsible for complying with all applicable laws, regulations, and obligations regarding their use of the Application and the Services.

Article 6 – Account Suspension, Access Limitation, and Termination


We reserve the right to deny access to all or part of the Service to any User who does not comply with these Terms and Conditions.

We also reserve the right to refuse and/or cancel a username/suspend an Account, at our sole discretion, in the event of fraud. The User will be notified accordingly.

In the event of a violation by the User of these Terms and Conditions, including the obligations detailed in Article 5, or if we have legitimate reasons to believe that such actions are necessary to protect our security, integrity, or that of other users or third parties, or for fraud prevention purposes, we specifically reserve the right to:

- Terminate our contractual relationship with the User immediately and without notice, in accordance with Article 12;
- Limit your access to and use of the Application and Services;
- Temporarily suspend your Account;
- Permanently close your Account.

Where necessary, the User will be notified of the implementation of such measures and may submit comments. These comments should be sent according to the procedures outlined in Article 14, "Contact." WeWard will decide, at its sole discretion, whether to lift the measures implemented.

These measures will take effect without prejudice to any damages that may be claimed from the User as compensation for losses incurred due to a breach of the Terms and Conditions.

Article 7 – The Wards


The most common questions from our users are regularly answered by our teams and are available in our FAQ

7.1 - Awarding of Wards

Creating an Account automatically enrolls the User in the Wards program. Wards are points that can only be used within the Application, primarily to unlock Rewards. The number of Wards associated with the User’s Account is displayed in the Account balance (the "Ward Wallet").

Users are awarded Wards by performing actions promoted in the Application (e.g., completing daily walking goals, validating quests, participating in contests, surveys, events, and/or any feature implemented for this purpose), including, but not limited to:

- By completing a verified physical activity (e.g., steps taken).
- By visiting geographic locations listed in the WeWard Application.
- By completing quests (such as downloading a mobile app, subscribing to a service, etc.).
- By answering surveys.
By taking specific actions on a bonus page (if applicable, details will be provided in the Application)
- By submitting a receipt on the WeWard Application.
- By making a purchase on a partner website after using the corresponding URL link.
- By making a purchase on a partner website after installing the extension and refreshing the link.
- By referring a third party who opens a User Account.

The number of Wards awarded for each action or challenge will be specified in the Application. This number may be subject to daily, weekly, or monthly limits, as well as validation criteria that may result in a delay in awarding Wards. The number of Wards awarded for an action or challenge may change, and the conditions for awarding them will be detailed in the Application.

The allocation of Wards through certain features available in the Application may require the purchase of goods or services provided by third parties on one of WeWard’s partner sites. The number of Wards allocated in this manner, as well as the allocation and verification procedures, will be specified within the Application. The number of Wards may vary depending on the User or the products or services purchased and may change over time. If applicable, the Wards will be credited to the Wards Wallet and can be used once the partner site has informed WeWard of the completion of the promoted action (e.g., visit, purchase, subscription, participation in events, etc.).The User is informed that the number of Wards granted may later be withdrawn from the Wards Wallet for various reasons, such as:

- After making a purchase, the User returns all or part of the purchased items.
- The User accessed the partner site using one or more systems not connected to WeWard's Services.
- The purchased products or subscribed services are not eligible for the promotion.

The User may be awarded Wards by referring others to register, as part of the Application’s referral program. The terms and conditions for referral rewards and the maximum number of Wards to be awarded under the referral program may evolve, and the details will be provided in the Application. We reserve the right to terminate the referral program and to deactivate a referral code, particularly if it appears on a review site.

We reserve the right and absolute discretion to determine and modify from time to time the physical activities eligible for Wards, the algorithms used to verify movements, and the number of verified movements required for Users to be awarded Wards using the Application. For example, we may modify the step verification algorithm or the number of steps required to generate Wards.

The User is informed and acknowledges that the collection and transmission of data from mobile devices or provided by partners as part of purchases, quests, or surveys, and generally any transmission of information over communication networks such as the internet, are subject to technical constraints resulting from technologies beyond WeWard's control. Despite WeWard’s best efforts in verifying the data, the inaccuracy or absence of the received data cannot hold WeWard liable. Therefore, WeWard cannot be held responsible for any errors, interruptions, unavailability, or inaccuracies of the information. We also reserve the right to retrospectively modify the Wards awarded to a User in case of errors or fraud.

7.2 - The Wards Wallet


The Wards Wallet is neither a bank account nor any form of payment instrument or service. It functions as a points program that allows Users to earn Rewards.

The balance in the Wards Wallet is non-refundable, non-exchangeable, and cannot be converted into any potential monetary value.

Wards must be earned and used in accordance with the rules set out in these Terms and Conditions. WeWard holds the final authority to determine whether a feature allows the earning of Wards. Wards will not be awarded and may be withdrawn at WeWard's discretion, particularly if there is suspicion of fraudulent use of any part of the Services.

We may modify or impose different balance and usage limits on the Wards Wallet at any time. In the event of any changes, you will be notified. Continued use of your Account after the applicable notice period (Article 3.2 of the Terms and Conditions) will constitute your acceptance of all such modifications. IF YOU DO NOT ACCEPT THESE MODIFICATIONS, PLEASE REFRAIN FROM CONTINUING TO USE THE SERVICES. In this case, WeWard will not be liable to refund, exchange, or offer any monetary discount for the remaining Wards in your Wards Wallet.

Any sale and/or exchange of Wards within or outside the Application and/or Services is strictly prohibited.

7.3 - Rewards

Depending on the number of Wards available in the Wards Wallet, the User can unlock Rewards displayed in the Application. Rewards may include virtual items, support for volunteer missions or humanitarian or environmental projects, participation in limited-time events, vouchers, partner discount codes, discounts on certain items, cash prizes, and/or the provision of goods or services.

Access to a Reward requires holding a specific number of Wards, as indicated in the Application. Some Rewards may also be obtained by using money in addition to Wards. Unless explicitly stated and displayed in the Application, the User will not be able to obtain the displayed Reward without having the required number of Wards corresponding to that Reward.To obtain a Reward, the User must follow the instructions provided in the "Rewards" section of the Application. The selection and use of Rewards are solely the responsibility of the User. Under no circumstances shall WeWard be held liable for any damage caused to the User or any third party due to the use of the Rewards.

The Application allows the redemption of Rewards as part of activities requiring the use of all or part of the Wards Wallet balance. The nature of the Rewards (virtual item, voucher, partner discount code, cash prize, goods, or service) will be specified in the Application. Certain options for using the Wards Wallet balance may require the use of Wards within a limited period and subject to a maximum number of participants and/or quantities displayed in the Application. The access details (start date and time, duration, number of participants allowed, quantities, etc.) will be provided in the Application.

If the Wards Wallet balance is successfully used to obtain the displayed Rewards, the User will be immediately informed of the balance usage and the assignment or shipment of the Reward. Depending on the Reward, participation in certain activities may be restricted to adults. WeWard reserves the right to verify the User's age.

Cash Prize Rewards. When cash prizes are available, unlocking and receiving rewards in the form of cash prizes require the User to provide WeWard with a bank account in the SEPA zone in the User's name (Bank Identity Statement - RIB). The User must verify their identity before receiving cash prizes. WeWard reserves the right to conduct any checks it deems necessary regarding the User's identity and/or age. WeWard shall not be held responsible if the provided RIB is incorrect, does not match the User's account, or if, for any other technical reason, the cash prize is not properly delivered. The User is informed and acknowledges that it is not WeWard's responsibility to verify the provided RIB, and that any bank fees, including those related to receiving the cash prize, will be borne by the User.

Advertising Sweepstakes. Unlocking certain rewards available in the Application may require using all or part of the Wards balance and may involve a random element without financial sacrifice. In the event of a win, the User will be informed of the prize and the details of the reward or how the reward will be sent or delivered. Note: Participation in certain operations and/or the awarding of certain rewards may be restricted to adults. For more details, please refer to the terms of participation for the specific lottery, available in the Application or in the relevant communication medium. WeWard reserves the right to verify the age of the User to whom the prize will be awarded.

Volunteering or Charity Projects. The Application allows Users to use their Wards balance for volunteering or charity projects run by or in partnership with third parties (associations, foundations, etc.). These projects are selected by WeWard and described in the Application. Users participate by using their Wards in a shared donation pool for the associated project, which is common to all Users of the Application. The amount collected in these shared donation pools includes all costs related to the project, including management fees for the Association and WeWard. These shared pools display one or more participation levels to be reached, allowing Users to show their support for the project. Once the target is reached, WeWard will inform Users and proceed with the actions described (for example, funding another partner's project). In the event a third-party partner fails to meet their obligations, WeWard reserves the right to take alternative actions, such as funding another project, without assuming any liability.

The unlocked Reward will be awarded as is. Rewards cannot be refunded in cash, exchanged, or credited for their monetary value, nor can they be offset against any amounts owed to WeWard.

The User acknowledges that WeWard assumes no responsibility for the features, products, services, or other benefits offered in the "Rewards" section of the Application that are provided or manufactured by third-party partners. The User acknowledges that the Company does not guarantee the quality, proper functioning, or security of goods, services, or other benefits offered on the Application. The User acknowledges that WeWard has no obligation for returns, exchanges, or refunds concerning the Rewards available on the Application.

Rewards available on the Application may be modified or removed at any time by WeWard, without justification and without incurring liability.

In case of unavailability and/or withdrawal of a Reward previously unlocked by the User, WeWard reserves the right to re-credit the User with the spent Wards or replace it with another Reward of equivalent value and similar characteristics, without being held liable.

7.4 - Virtual Products

Virtual Items: WeWard also provides its Users with a game that allows them to collect virtual items. Information about the game rules is available here. Users have the option to gift a virtual item to another User. This action is irreversible.

Users can obtain virtual items in 3 ways:
- By walking a certain number of steps per day;
- By reaching the GPS point of the virtual item;
- By purchasing virtual items with Wards or euros.

When purchasing virtual items, Users are subject to these General Terms and Conditions of Sale (GTCS).

E-vouchers :
Users have the option to purchase vouchers through the Application and earn Wards for every euro spent. The number of Wards granted will be specified in the Application for each partner. This number may be subject to daily, weekly, or monthly limits. The number of Wards granted and the conditions for granting them may evolve and will be detailed in the Application.

The eligibility conditions for these vouchers (e-commerce websites, partner store lists, eligible products list) will be specified in the Application.

In the event of a clearly erroneous price display (e.g., due to a technical bug, manual error, or any other reason), the order—even if validated by us—may be canceled, and the Wards may be deducted from the User's balance.

Vouchers cannot be exchanged or refunded (in full or in part), as the usage information is sent by email and received immediately.

7.5 - Suspension or Deletion of Account Related to the Use of Wards

Under all circumstances, the User must behave fairly when participating in and using the Wards.

The User agrees not to intentionally provide false data to WeWard, such as falsified GPS coordinates, incorrect physical activity data, or receipts that do not belong to them. The User agrees not to enlist third parties to generate Wards on their behalf.

The User agrees not to attempt to find loopholes to accumulate Wards, such as:
- Artificially simulating steps (e.g., using balance devices, software, etc.);
- Artificially simulating geolocation points;
- Issuing computer queries to falsify physical activity or purchase data;
- Sending falsified receipts or receipts that do not belong to them;
- Falsifying referrals.

Article 8 – Intellectual Property


The Application, trademarks, logos, and any other distinctive signs of WeWard and/or its partners, as well as any software used in the provision of the Service, and the content of the Application (i.e., any text, video, photography, or any other information in any format and of any nature displayed on the Application) are the exclusive property of WeWard and/or its partners, and/or third parties, and may be protected by copyright, trademark law, patent law, or any other intellectual property rights. These Terms and Conditions do not transfer any ownership rights to the User.

Consequently, it is prohibited to copy, modify, reproduce, distribute, publish, integrate onto any medium, adapt, transfer or assign, license, sublicense, pledge, or otherwise transmit any elements of the Application or perform reverse engineering or use any other method to attempt to access the source code and/or protocols of the Application without the express permission of WeWard or the rights holder. The User agrees not to use the Application or the Website in an unlawful manner or in a manner incompatible with these Terms and Conditions, or to act fraudulently or maliciously, for example by hacking or inserting malicious code, including viruses, or harmful data, into the Application or the Website.

The User agrees to:
- Not infringe the intellectual property rights or those of third parties in relation to the use of the Application or Website.
- Not transmit any defamatory, explicit, offensive, or otherwise objectionable content on the Application or Website.
- Not use the Application or Website in a manner that could damage, disable, overload, harm, or compromise our systems or security or interfere with other Users.
- Not use any technology that interferes with the proper functioning of the Application or Website, including blocking any advertisements or promotions displayed on it.
- Not collect or harvest information or data from the Application or Website for commercial purposes, unless otherwise agreed in writing by WeWard.

If WeWard discovers a violation by the User, WeWard reserves the right to immediately suspend or terminate access to the Application and delete the corresponding Account.

The Website and Application may contain links or content from services that are not operated by us and provide additional content or functionality. The content of these third-party services is governed by the terms of use and privacy policy of the respective third-party service providers, and solely their responsibility. WeWard is not responsible for the availability or accuracy of third-party services, or the services, products, or content available from these services. The inclusion of links to third-party services or their use does not constitute WeWard’s endorsement of these services. For more information, we invite you to consult the terms of use and/or privacy policy of the relevant third-party services.

Article 9 – No Medical Advice


The WeWard Application allows Users to track and monitor the quantity and frequency of physical activity, generate Wards, and use them to redeem Rewards. The services provided by WeWard do not contain, constitute, and should not be interpreted as medical advice or medical opinions. WeWard is not a licensed healthcare professional, does not collect health data, and is not able to provide medical advice. Users should always consult a qualified and licensed healthcare professional before starting or modifying any diet or exercise program. The WeWard Application is not a tool for diagnosing or preventing diseases. The use of the Application does not create a doctor-patient relationship between the User and WeWard.

Article 10 – Personal Data


As part of using the Services, we may collect and process certain personal data of the User.

Upon registration, the User acknowledges and agrees to the processing of their personal data by WeWard in accordance with applicable law and the terms of our Privacy Policy. For more information about the data we collect from you and how we use it, please refer to our Privacy Policy.

Article 11 – Liability

11.1 - Use of the Application and Website


Due to the technical constraints inherent in the use of the Application and Website, WeWard’s liability cannot be engaged in the event of damage caused by a malfunction in one or more steps of accessing the Application and/or the Service offered. This includes, but is not limited to, issues related to the use of the Internet network, such as service interruptions, external intrusions, the presence of computer viruses, or any other type of malfunction. The User is encouraged to report any issues encountered during the use of the Application to WeWard without delay.

WeWard does not guarantee optimal functioning of the Application if the version being used does not correspond to the latest version available on download platforms (Google Play and Apple Store). WeWard’s liability will not be engaged in the event of damage caused by a malfunction in a previous version of the Application.

If WeWard has legitimate grounds to believe that the security of the Application is compromised or that misuse of the Service is due to unauthorized use of the User's login credentials, WeWard may temporarily deactivate the User's Account to protect the integrity of the Application and the data associated with the User's Account.

The User agrees to use the Application in accordance with its intended purpose and not to engage in any illegal, unfair, dishonest, or fraudulent activity, including actions aimed at artificially increasing the number of Wards beyond those corresponding to actual physical activities and visits to locations.

WeWard's liability shall not be engaged in the event that the non-performance or improper performance of WeWard's obligations is attributable either to the behavior of the User, or to an unforeseeable and insurmountable event caused by a third party (including the sources of information published by third parties), particularly partners over whom WeWard has no control, or due to a force majeure event, as defined by Article 1218 of the Civil Code. Force majeure includes, but is not limited to: natural disasters, fires, strikes, breakdowns, shortages, war, power outages, telecommunication network failures, or loss of internet connectivity due to public or private operators.

Furthermore, WeWard’s liability shall not be engaged for any indirect damages arising from these terms, including loss of business, loss of profit, damages, or expenses.

Without prejudice to the exclusions of WeWard's liability outlined in these Terms and Conditions, WeWard’s liability may only be engaged for the compensation of direct, actual, foreseeable, and certain harm suffered by the User, provided that the User demonstrates that WeWard's contractual fault is the direct cause of their harm. The User acknowledges and agrees that the following cannot give rise to compensation: loss of opportunity, loss of business (in the accounting sense), loss of productivity, contracts, and/or margin, loss of earnings or Wards, as well as failure to achieve anticipated savings or profits or any damage to reputation.

In any case, and in the event that WeWard’s liability is engaged, the compensation owed shall not exceed the value of the Rewards that would have been attributed to the User through Wards over the three (3) months preceding the incident.

To facilitate exchanges, the User acknowledges that the computer systems and files of WeWard will be considered authoritative, unless they provide conclusive evidence of at least equivalent value.

As a result, the files and records stored within the computer systems operated by WeWard or on its behalf under reasonable security and reliability conditions may be validly used and produced as evidence of the performance of these Terms and Conditions, and more generally of any event, communication, or interaction between the parties related to the User’s use of the Services. WeWard may validly produce, as part of any legal proceedings, data, files, programs, recordings, or other elements received, issued, or stored using the aforementioned computer systems, on any digital or analog medium, and rely on them, unless there is a manifest error.

11.2 - Liability Related to Virtual Products


Section 11.1 remains applicable to Virtual Products.
Additionally, you acknowledge that you are solely responsible for the purchase, collection, use, and all consequences related to Virtual Products. WeWard commits to doing its best and taking all reasonable measures to ensure easy access to Virtual Products, but WeWard relies on your sense of responsibility when collecting Virtual Products.

If certain Virtual Products are located in potentially dangerous or hard-to-access areas, by using these Virtual Products, you assume full responsibility for any associated risks, including, but not limited to, accidents potentially caused by an inappropriate or hazardous location of a Virtual Product.

WeWard, its employees, suppliers, service providers, or subcontractors cannot be held liable for any incidents occurring during the purchase, collection, or use of these Virtual Products.

You agree to defend, indemnify, and hold harmless WeWard, its employees, suppliers, service providers, or subcontractors from any claims by you or any third party, as well as any damages, liabilities, losses, costs, or expenses resulting from the purchase, collection, or use of WeWard's Virtual Products.

This liability waiver includes any accidents caused during the purchase, use, or collection of Virtual Products, whether you are on foot, in a motorized vehicle, or in any type of location, private or public.

Article 12 – Term of the Agreement - Termination

12.1 - Term of the Agreement

The Terms and Conditions are entered into for an indefinite period starting from their initial acceptance by the User, as described in Article 1.

12.2 - Termination or Suspension of the Relationship by WeWard

WeWard may suspend or revoke access to all or part of the Application and Services in the event of a breach of these Terms and Conditions by the User. In such cases, WeWard will notify the User of the suspension and/or account termination via email and issue a formal notice to cease the violation.

In the event of a suspension, the User may rectify the breach within three (3) days from the date of notification. If the breach is not resolved satisfactorily within this timeframe, WeWard may terminate the contractual relationship with the User by operation of law, without prejudice to any damages or compensation WeWard may seek for harm caused by the situation.

This termination may occur without prior notice in the event of a serious violation by the User of their obligations under these Terms and Conditions.

WeWard reserves the right to deactivate a User's account following a period of total inactivity of thirty (30) days or more. However, the User will have the option to reactivate their account, provided the period of inactivity has not exceeded twenty-four (24) months. This period is calculated from the date of the User’s last login to the Application.

12.3 - Termination of the Contractual Relationship by the User

The User may terminate their contractual relationship with WeWard at any time, free of charge and without providing a reason. To do so, the User simply needs to go to the Application’s Settings and click on the “Delete my account” option.

Within forty-eight (48) hours following the account deletion, some or all of the User's data may be erased from WeWard’s databases, and the User will no longer have access to the Application or its Services. The deletion of this data is subject to WeWard’s legal obligations and commitments outlined in the Privacy Policy.

In the event of the User’s death, upon submission of relevant supporting documents, the account will be deactivated. Its content may only be transferred to heirs based on a court decision or under conditions provided by applicable regulations.

Article 13 – Disputes


These Terms and Conditions and their interpretation are governed by French law, without prejudice to applicable conflict-of-law rules, except in the case of overriding mandatory provisions.

In accordance with Article L. 612-1 of the French Consumer Code, the User has the option to use a mediator free of charge to seek an amicable resolution to any dispute with WeWard. The User is invited to contact WeWard to submit their request, so WeWard can provide the contact details of the mediation organization and the specific conditions for using this mediation procedure.

The User may also consult the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/main/?event=main.consumer.rights.

If mediation fails or is refused, any legal action will be brought before the competent court in accordance with the provisions of the French Code of Civil Procedure.
